Legal Question in Bankruptcy in Minnesota
Stopping foreclosure
If I am behind in my mortgage payments, will filing Chapter 13 stop foreclosure and give me time to catch up with the payments that are in arrears?

Re: Stopping foreclosure
A Chapter 13 allows a debtor to stop a foreclosure and get current with the mortgage. The case must be filed prior to the sheriff's sale and typically cure the mortgage arrears between 12 and 24 months. The best course of action would be to contact a bankruptcy attorney to meet with him or her and get your case file ASAP.
