Legal Question in Business Law in Minnesota
What are we as a 503 (c) (3) required to give members?
Is there privacy issues with giving them personal information?
We have a member who is asking for........
~ Other members personal information (address/phone numbers/email addy)
~ How much other members have fund raised
This member also wants copies of checks written from the account
~ to get copies of the checks it would cost $2.00 each (3 years worth about 500 checks)
Are we required to give him copies of the checks?
Could we make him pay for them?
1 Answer from Attorneys
State and Federal law, plus your organization's Bylaws govern this question.
In short, a "Member" is usually entitled to the same disclosures as the publicly reported information.
SInce you are a 501(c) (3) you have annual disclosure obligations to maintain your charitable status.
Also, since you are a 501(c)(3) there are no "owners".
I would want to review your ByLaws and examine the request for records fully before providing a formal opinion.
