Legal Question in Business Law in Minnesota
We are looking at adding a new business name and having some employees merge to that business/name. If we have contracts/agreements with employees/contractors that we move to the new busienss/name, will the contracts/agreement still be legal/active if the employee is moved and we do not have them sign a new contract/agreement under the new busienss/name.
Thank you

As a Franchise Attorney I can only ask that you repost your question with more detail. What do you mean by "having some employees merge to that business/name?" What kind of business do you operate? What do the affected employees do for your business. You also mentioned contractors; where do they fit into this picture? What is the current business name and what name do you want to add? Without this detail, it's not possible to even begin answering your questions. Consult with a good business or franchise attorney in your area for specific advice.

If only a new DBA nothing changes if remain employees of orig . Employer in MN.
If a new ENTITY , you need new Contracts , new Tax ID #, new everything .
It is difficult to tell what your intentions are from your question. If it is merely a name and/or location change you probably wouldn't have to worry about anything. If it is something more, like starting a new business, you may have to start anew with the employees and amend your contractors' agreements. Failure to approach this properly could leave you with unenforceable contracts.
