Legal Question in Business Law in Minnesota
I'm an artist living in Iowa and have work represented by a gallery in Minnesota. Due to lack of sales I want to pull my work out. Per the contract I have to give 14 days written notice, which I did. I asked that she let me know when we could get together so I can pick up my things. That's been over a month ago. I've tried to contact her multiple times via email, phone, and messages with no response. What are my options to get my work back if she doesn't respond? Can I get my things when she isn't present?
1 Answer from Attorneys
As a Franchise Attorney I can say it looks like you will have to go to court if she continues with no contact. You can't just pick up your art as this would be trespassing. As a prelude to legal action you can also consider (1) having an attorney write her a demand letter. This may be enough to shake her up. Other option (2) is for you to travel to MN, show up at the gallery and try to deal with her directly. Consult with a good business or franchise attorney in your area for specific advice.
