Legal Question in Business Law in Minnesota

buisness

If I wanted to start a buisness where I drive people, who are too drunk to drive, back to there house in their car so they don't have to worry about getting it back the next morning would I have to obtain any type of specific license?

You will need a chaffeur's license, and perhaps other city business licenses. ALso, I would highly recommend you incorporate or form an LLC to do this kind of business.

Re: buisness

Thank you for your question. This is a terrific business idea, if you can find a way of getting paid. My only concern would be for your liability resulting from not only damage to the client's car, but from claims made by an individual who will be impaired. There are a few things to remember.

First, if you are driving others for a fee, Minnesota law requires a chauffer's license.

Second, depending on how you operate your business, you may also have to comply with a variety of city ordinances. Some municipalities may consider you to be similar to a taxi service.

Third, remember that you are taking a risk every time you operate someone else's car. You would be wise to ensure the client has insurance, among other things, since you will get the ticket if the client's car does not have proof of insurance, for example. Issues such as this would have to be evaluated very carefully.

Finally, you should only do this if you are operating as a corporation, to limit your personal liability. The risks are otherwise too great.
