Legal Question in Business Law in Minnesota

Collection

What is or is there a law that protects a small engine buisness from a customer that brings a piece of equipment in to be fixed and does not return to pay their bill or pick up their snowblower? Is there a legal amount of days in which the item can be sold to cover the expenses that have been acrued to repair the item? Are there a set of guidelines in which a person must follow first?

Re: Collection

Here are links to some of the statutes that appear to relate to your situation. As you will see, if the services haven't been paid for within 90 days you should be able to exercise your lien rights. Note, the requirement for "personal service" means it has to be hand-delivered by someone like a process server, or the county sheriff. Good luck!

Re: Collection

Serveral years ago I had a regular arrangement with an auto repair shop where I would set up a sheriff's sale to foreclose on autos they had repaired but which were then abandoned by the customers. The trick was to combine the repair bill with enough storage charges to exceed the value of the vehicle - then my client was able to get a title to the vehicles in question.

I would think a snow blower would be a lot easier to deal with than that. I see you have already been referred to some statutes.

Good luck.
