Commission sales rep in MN
Hi,
I am aware of the Minnesota rep law which protect commission sales rep. Our company recently fired a rep. However, we will continue to pay him commission in the territory for the next 90 days. My question is - Do we, as the manufacture need to pay this sales rep commission on accounts being picked up by the new sales rep? Or, the rep shall only be paid commission on accounts established by himself, and not the new rep. Your help would be greatly appreciated. Thank you.

Normally this would be governed by a written sales commission agreement, but in the absence of that, commission arising from the territory during the 90 day period would be paid to the terminated rep, regardless of who originated it. Are commissions payable upon receipt of order, or upon payment by customer or delivery of product?
