can a company enforce non compete if they are either out of business or filing a chapter 7

Possibly- the business could be sold or its assets transferred (even after BKY) and one of the main assets could be goodwill, customer lists etc.
So a Non-compete would be a priority for enforcement in such circumstances.
(Keeping the Golden Goose alive and laying eggs).
