employer rights?

Hi. I own a flooring business. I hired a man to install ceramic full time. After 3 weeks we were receiving complaints about his craftsmanship. My female assisstant contacted him after his shift on a friday and advised him to come into the office to discuss complaints, about that days work, by the customer who threatened to never use our co. again. He told her there was nothin wrong with the job and said he would not come in. My assisstant commented that if he didn't that he may loss his job. He then hung up on her. That evening I received a text message on my ''I quit, that f__kin C_nt is going to wreck your biz''. My assisstant contacted me (saturday) informing me that he had also contacted her the previous evening but with much more anger and hatred. He called her numerous times leaving messages using the same profanity that my text contained and much worse. At one point this single mothers daughter answered the phone and heard everything. he was obviously drunk and angry. the next week he demanded his check or he would call the better business bureau and the state . is there anything i can do to this jerk as an employer. she asked me that he doesn't get his last check. His bad work lost us our biggest customer. Over $1M a yr.

He should be immediately terminated, but you should pay him through his last day of work.

Unless you have a different notice period in an employee manual etc., he can be fired immediately.

Document and save the text message, and have your assistant write down the exact conversation to the extent possible. You should also contact your customers to "fix" any problems, give discounts, etc. and let them know you have terminated the problem employee.

There may be a lawsuit from the terminated employee, but you should prevail.
