Legal Question in Business Law in Minnesota
We are an equipment dealer filing a warranty claim to one of or distributors. The distributor says that they will pay us a standard warranty reimbursement rate of 80% of our average labor rate. Our labor rate is $67.50 and they are saying that they will reimburse us at $54/hour. We found a couple of statutes that we feel apply. Can you tell me if these would pertain in this instance? (Statute 80E.04 and S.F. No. 674) Both statutes say that payment should be paid at the dealers customary rate or not less than the amount charged to a nonwarranty customer.
