Legal Question in Business Law in Minnesota
I live in Minnesota. In 2008 purchased a franchise for a mobile automotive repair business from a Michigan-based corporation. Is the arbitration agreement I signed binding in the state of Minnesota?
Can I take legal action against corporation for misleading/fraudulent business practices?

Any good franchise attorney will say a review of both the franchise agreement and FDD Franchise Disclosure Document are required before the arbitration question can be answered. I worked on a franchise matter where we were able to successfully invalidate the arbitration clause. This is not an easy thing to do. As to whether you can take legal action will depend on a review and analysis of your circumstances and whether everything was disclosed properly to begin with. Consult with a good franchise attorney for specifics.
