Selling Farm Machinery in Newspaper

If your selling an old hay rack in the paper and it doesn't have a safety shield on the power take off...if something happened later could that person hold us accountable?

There are always concerns about that kind of thing. Whether the plaintiff could win or not is something I cannot tell at this point, but there is nothing that would stop a potential plaintiff from suing you. All that said, there are ways to limit your liability or otherwise protect yourself. I would recommend consulting with a lawyer before selling this equipment.

It would be a legitimayte conceern and, as a result, any contract would have to include specific disclaimers regarding the condition of the equipment and the repairs necessary to remediate any defective conditions.
