Legal Question in Business Law in Minnesota

I know someone who started up a business of driving drunk drivers and their cars home for a flat fee. This business is well established in a relatively small market. I want to start up my own business like this in a different town with a different name. Is there any way that he could sue for me using the idea and using a different name.

No , but there are numerous liability and insurance issues which you will want to cover before starting up, especially establishing an entity like an LLC, AND having strict waivers in your contracts.

Insurance is a major concern as well. Your drivers may need special license designations as well.

No. So long as you signed no confidentiality agreement or, as part of a working relationship, signed a non-compete, you should have no restrictions in setting up a similar business, even one that competes in the same market.

You should be careful to incorporate your business so oit has limited liability as well as acquiring a business liabilty policy should any accidents occur. You should check to be sure that no licenses, such as those required for cab drivers, are neccessary,
