Legal Question in Civil Rights Law in Minnesota

Age/Sex Discrimination

I have a sex/age discrimination charge against my company. We are getting ready for mediation within the next month. I'm not sure what kind of monetary settlement I should ask for. I was thinking around 5,000.00, plus salary adjustment, but everything I have read about the subject talks about very large sums awarded in a jury trial; 250,000 seeming to be an average amount. Does mediation work or should I hold out for a jury trial? I have proof that the company lied about the male's job duties in an attempt to cover up the discrimination. I am not the only who is having problems with this manager and am aware of other possible discrimination and breaking of rules this company engages in. I also feel that I have been harassed and retaliated against, since last December when I first informed my manager that I knew a much younger male with no accounting experience was making more money than me. I have not filed any charges for those two as of this date.

Re: Age/Sex Discrimination

No one can answer this question but your lawyer, who is aware of the facts and circumstances of your case.

Don't try to settle the legal case on your own, since you don't know the true value of your case. What may have seemed a big settlement or a little one in someone else's case has little to do with the appropriate value of your case at mediatio or trial. And, yes, mediation "works."

Please do not suggest that you haven't retained one, because settlement of your claim is the end of the road and you will undoubtedly be asked to waive any right to future claims.
