is it illegal to allow a 5yr old to play in his own yard unsupervised?

It probably comes down to what you mean by "unsupervised." If the 5 year-old is home alone without a responsible person to be found, it could probably lead to criminal charges. If the child is playing in the yard, but a responsible person is within a reasonable distance from the child, it probably wouldn't be a problem (i.e. mom is doing the dishes while the child is playing in the sandbox). This is really too fact specific to give an appropriate answer.
