Legal Question in Civil Rights Law in Minnesota
Recently my boyfriend was arrested at his home because his grandfather called the police because he and his brother were rough housing. He was under the influences of alcohol. He spent the night at ditox but before he was arrested they searched his room without permission and found a small amount of weed, baggies, and a scale in a safe next to all his money that he has been saying for many years. And now he has court, and they�re trying to convict him of attempting to sell. Wouldn�t anything found during a search without consent automatically be non-useable because they didn�t have a search warrant of permission?

There may be a chance that the evidence could be thrown out, but it would depend on more than just whether or not your boyfriend gave them permission. The prosecution certainly is not going to just throw in the towel. Did the grandfather give permission? Was it reasonable under the circumstances?
