Legal Question in Civil Rights Law in Minnesota

Rights as a ''witness''

I was involved in a group claim against a company for various forms of harassment. I filed three years ago, and just settled a few months ago. It cost me a fortune, in both time and money. I was just notified by the attorney who represented me that he wants me to testify as a witness for the one person in our group that hasn't settled yet. I can't put myself through that again, physically or emotionally. What are my rights? Do I have to? I haven't been given a subpoena, I have testified about this other person in my own deposition (which I have to pay for each time over $500 and have been deposed 3 times) I just started a new job, am building a house (literally) and will have a nervous breakdown I swear if I have to do this. The defendants attorney is cruel and wants me there for a week. What can I do? I cant talk to my attorney about this, he berates me with a speech about my duty as an american citizen and could care less if I have severe emotional problems due to this whole mess.

Re: Rights as a ''witness''

You have no duty to testify or participate further. If your own well-being will be adversely affected, you should not.

If you are not under subpoena, you have no obligation to show up anywhere and you have no obligation to speak with anyone. Don't answer their calls.
