construction law-roofing contractor
I am being taken to small claims court by a contractor who did no actual work. I signed a contract for his services, but he did not sign the contract. Is it still binding?

Hard to tell from the limited facts given, but the general rule is that if you signed a written contract it is binding against you even if the other person didn't sign it. However, by taking the contract to court, the contractor is in essence adopting it...so, in defending, you would presumably be entitled to assert any defenses available to you relating to the contractor's failure to perform the contract (e.g., schedule of the work, etc.). Subtle distinction, perhaps, but worth pointing out.
