Legal Question in Construction Law in Minnesota
Contractor issue
I have a contractor (storm chaser) that didnt even start the job after my many proactive attempts. Now almost a year later he is leaving me a phone message threat of a lein. But I already had him sign a lien waver after i had enough of his crap, I figured he understood what he was signing? Now he is claiming that he pulled a permit and that it was a cost to him; we hadn't even agreed or finalized on the work to be performed? I will never again sign a contract. Do you think he has a case? The only work he did was meet with the adjuster. Do I just ignore him. I am going to contact the city tomorrow and see if he actually pulled a permit. I decided to do the work myself with the help of some of my home builder friends.

Re: Contractor issue
It's hard to say if he has a case or not. I'd want to examine all of the facts before deciding. You should be aware that there is a tort for Slander of Title, which is often asserted as a counterclaim in mechanic's lien cases. On these facts, I can't tell at this point if you have a valid claim for that or not. There certainly appear to be some good facts in your favor.
