faulty work

I hired a contractor to make an addition for me it leak's watter, and i haven't paid him yet. He refuses to fix it but wants me to pay him eventhough his mistake is causing the leak. I paln on hireing another contractor to fix his mistake and deduct their price off his bill. Is this ok

Yes, with some speed bumps along the way.

You should first make sure to send him written notice of the problem and formally give him one more opportunity to inspect the problem and to fix it. This notice must be given to the contractor within six months from the date you first discovered the damage. After he receives the notice, the contractor has 30 days to inspect the home and fix the problem. If he does not, then you can go ahead and fix it.
