Legal Question in Construction Law in Minnesota

plumbers lien

We recently had our bathroom remodled our plumber has sent us a bill for installing a bathtub/shower that was already part of the contract price. He claims that since it was only a temporary install that he can charge us extra for doing so since this was our only working bathroom in the house we needed to have a shower to use. SO he ''temporarily'' hooked it up although he had already run all the pipe and water to it all that need to be done was put the faucets and shower nozzle on ..Are we liable for this extra charge in essance he is being paid twice for the same work? Also during this time he had ordered the wrong tub forgot to order the surround and installed the wrong toilet he only had 90 days to complete this work and that time was up on Jan 4 2007 he finally finished it on Jan 15th what legal rights do I have he has threatened to put a lien on our house for this money. And We really can't afford a lawyer to persue this matter.

Don't know enough about the contract terms and what was discussed to be able to offer an opinion on whether or not the "temporary" hookup should be considered extra work. If it was a verbal contract, it would likely get down to a he said / she said fight.

As for the lien, unless he gave you written pre-lien notice, filing one against your property would be illegal.
