Legal Question in Consumer Law in Minnesota
Car dealer didn't follow through
I purchased a car from a dealer and traded my old van in. In the deal I borrowed enough money to pay for the new car & to pay off the old one. The car dealer was supposed to send in payment to my bank of $4500 for my trade in but he went out of business and has not paid off my trade in. I have left numerous messages with him but never get a return call. What do I need to do to get the money out of him? I turned the info into my bank's fraud unti but haven't heard back from them yet. Can I be held resposnible for this since I followed through with everything that I was supposed to do?

Re: Car dealer didn't follow through
You can take him to court, but he went out of business. If your deal wasn't registered with the bank on the original loan, then you will have to get this sorted out in court, because until then, they still have the legal right to recover from you. if he has filed bankruptcy, it will all be shifted over the the BR court, so find that out first, so you don't waste money and time.

Was the dealer an individual or corporation? How long ago did this occur?
I may be able to assist you in recovering the amount paid.
