Contractor not finishing job
I hired a drywaller to work on my new house. Start 10/3/05. He said he would finish in 5 days by 108/05. He did not. He then left the state to go to another job on 10/10/05. He stated he would be back and I would be ready to paint by Saturday 10/15/05. I spoke with him on 10/12/05. He said he would be back on Sunday 10/16/05. I have left numerous messages on his phone. I have not heard from him and he has mnot shown up to finish the job. He was paid $2500 to start and the final would be paid upon finishing. He did sign a lien waiver from the bank to cash the first check. Can I replace him with another drywaller to get the job finished. I am running out of time to get into the house and all the rest of the work is dependent on the drywall being finished.

I would need to see any written contract or other written documents between you and the contractor to advise you.
Otherwise you would do well to have an attorney FAX or e-mail a letter to the contractor advising him of your rights after a breach of contract.
