Legal Question in Consumer Law in Minnesota

FTC ruling

The FTC has just released a stipulated decision against Cyberrebate.com (Civil Action No. 04-3616)

My question is: Can this be used to show that Cyberrebate committed fraud and therefore my credit card company should stand behind the disputed claim for reimbursement of money. There is a fraud clause in the credit card agreement.

Thank You

Re: FTC ruling

I would have to review both the FTC decision as well as the CC Contract in order to render an opinion. The answer could well be yes.

Re: FTC ruling

Unfortunately, your question does not give sufficient facts to provide a complete response.

The FTC ruling may or may not be applicable to the specific facts of your case.

Your question does not indicate that Cyberrebate.com actually committed fraud against you, personally. Obviously, if you were defrauded, the FTC ruling MAY be helpful to your reimbursement claim.

On the other hand, if the company did not defraud you personally, then you might not be entitled to the benefit, if any, of the FTC ruling.

Please consult an attorney as soon as possible to discuss the specific facts of your case.
