can a Merchant sue you for a Customer Review on a web page?

like this it was a black top comp

they did the drive way and left a hole and big mark and said it was fine ..other things are not right also but to many to list not very happy poor service all around

not happy at all not doing work like i asked they say pay when done now want $$ b4 they can get materials to do the work not happy

not happy so far did not take out what i wanted left things for me to get rid of like tree roots. have big ruts in drive way. call to ask about it and get run around and they don't seam to care.

What you are asking about is defamation laws, and the answer is actually fairly simple. Truth is always a defense to defamation. If you write a customer review and tell the truth about the quality of service, they cannot win a lawsuit against you. This is not, of course, to say they cannot sue you, just that they cannot win.

Your post also implies another question: is there anything else you can do? The answer is yes: if the quality of their service was so low that they didn't effectively finish the job, you can sue them to do it right. An attorney in your area who practices contracts law would be able to help you with this.
