Product Rebate Rejection

Hi,

I bought a chair from a company that was advertised with a $30 dollar rebate from their website. I returned the rebate form as instructed with the invoice and upc as required. They rejected my claim because I am not a company and they claim their rebate is only valid for companies.

The rebate form makes no mention of this policy. It requires that the parties name and address on the invoice match that one on the rebate form. It also requires that the form be filled out in its entirety. I met both these requirements. On the rebate form, it lists a line for company name, I filled in this blank with n/a, not applicable. They claim that since there is a company blank on the form, it must be filled in with a company name. Therefore the rebate is only offered to companies. The consider my n/a answer on the form as invalid.

The rebate is clearly addressed to all purchasers and end users from the language of the offer. I am planning to file complaints with the texas attorney general, the post office, and possibly a small claims suit to gain leverage and force their hand. Did they break the law? What actions can I take to make them pay? I have copies of the rebate offer and invoice.

You are on the right track. Arguably their conduct is a violation of numerous consumer protection acts, and while you can sue them in Texas in Small Claims, you'll have a hard time collecting in Minnesota.
