auto co-signer's rights

My husband is a co-signer on his step-son's truck. My son has been late several times on his payments. he helps him get back ''on his feet'' and my son is on time, then it happens all over again! Right now, my son is no where to be found, nor is the truck. My husband has just ''bailed'' him out by paying 3,300.00, fearing the financial co. would take from our accounts on their own. right now, my son still owes over 4,000.00. we have paid more than my son on that truck. do we have a legal right, if we find the truck to ''pick'' it up legally and take ownership of it, and ''get'' a key made(we do not have one)? my son has totally ruin my husband's credit. Does my husband have ''any right'' to it? can he take legal action to get it? Is the only way to legally ''own'' it, is to have my son sign ''off'' on it? Of course we don't know where he, nor the truck is and he won't answer our calls. this is truely putting a ''damper'' on our retirement and our marriage!!

NO, you can't "pick" it up. You will need to "sue" him in court for the money.
