Legal Question in Credit and Debt Law in Minnesota

bounced check

My girlfriend recieved a call from a collection agency for a check written approximately 10 years ago. She is threatened with a felony, and jail time if it is not paid by the end of December. Her husband, at the time, wrote the check. He is an unemployed drunk living in Michigan, and she still lives in Minnesota. By law, is she obligated to pay after all this time? Paying the debt is not a problem, but the amount of time between the time it was written, and today is quite astonishing. They held a joint checking account at the time, and the account was closed about 8 years ago.

Re: bounced check

If it is a 3rd Party Collection Agency there may well be a violation of the Fair Debt Collection Practices Act, which means damages could be collected against the agency.
