Legal Question in Credit and Debt Law in Minnesota

Car repossession

I had a car respossessed almost two years ago, apparently they sold the car at auction and said that I still had to pay the balance due on the loan. They never send me any payment book or had any other contact with me except for the initial letter stating that I still owed money on the load. I made payments to them for about a year after that. When I got to the point where I figured it was paid, I stopped making payments. I didn't hear another word from them. Now 1-1/2 years later I get a letter stating that I still own them a couple thousand dollars. Do I have any rights in this situation?

Re: Car repossession

Yes, of course you have rights. First you have the right to a full accounting of what happened to your car - how much was it sold for, an itemization of the expenses of sale with proof of the expenses. You have a right to a full report of how they calculated the amount you owe - if any.

However, enforcing those rights may be more difficult. I suggest you see a lawyer - if you can't afford one, ask Legal Aid for help. Most bar associations also have a panle of lawyers willing to work for a reduced fee.

Good luck!
