collection agency

can you send a letter to a collection agency telling them to stop calling you? what happens then? I have a chase card that went into collections and the company will not work with me, because the said I waited to long to respond. I am trying to find someone to help me on this, but i do not know where to go. They have even called my husband and told him to cash in his 401k. This is my debt not his. Help

You can certainly write the collection agency and tell them that all future contact must be in writing. As to the issue of your case --what to do about the debt -- it may depend on where you are in the process -- them claiming that you "waited too long to respond" might mean they actually sued you and got a judgment or it might mean that they are just running you around. You can usually settle these cases at a substantial discount; you may have some defenses, such as a claim that the collection agency has violated the Fair Debt Collection Practices Act. I suggest you contact an attorney near where you live -- your question did not give ZIP code -- and have him or her review the collection actions.

If it a 3rd Party Collection Agency ( and is not collecting their OWN account) they are bound by the Federal Fair Debt Collection Practices Act. If you write them and tell them to stop calling, they are prohibited from calling again.

They may then just bring it to an attorney to sue it out.

I can arrange lump sum payment discounts on unsecured ( usually Credit Card ) debt.
