Old ''haunting'' Debts
My husband consolidated credit card debts back in 2001 with a consolidation company. He paid $750.00 per month over a period of about 6 years.
He has proof of payments made, and their disbursements in the form of statements from the consolidation company.
Currently, the same credit card companies that were paid in consolidation are going into collections, after 3+ yrs of no contact.
Last year, a company passed judgment for nearly $5k on an original $6k debt- which he paid $9k on- according to our consolidation statements. The company was even sending payments made back to him, stating that the account was paid in full in 2005. Judgement was passed in 2008.
We currently have another company trying to collect. We sent a debt validation letter 11-13-08. They served us with a summons 12-31-08. They did not validate the debt in any way. We contacted a yet another lawyer, responded with an answer, and are waiting. We have other accounts in good standing- these old ones are still haunting us. We have contacted several lawyers and all turn us away. We don't understand why, or what we can do to protect ourselves. Any advice or information you can give us is greatly appreciated. We are at our wits end with old debt. Thanx in advance.

SOunds like claims would be barred by Statute of Limitations or Accord and Satisfaction.
Unfortunately, you are likely going to need to incur legal expenses to get to the bottom of these issues.
