Legal Question in Credit and Debt Law in Minnesota

home loan

My ex kept our house... i signed the ppwk two years ago to get my name off the title and off the loan.. he got me off of the title but has done nothing to get me off the loan. This is affecting me now as Im trying to get a loan myself and I cant due to debt to income ratio. Is there any thing I can do to get my name off or make him take my name off, especially since he took me off the title. He still lives in the house and I moved out with our kids two years ago.

The answer depends on what your court order requires. If it does not require that your former spouse refinance to remove your name from the loan, then there is no such obligation.

If the decree does not obligate your husband to refinance, you can ask the bank to release you. The bank is not obligated, under most types of mortgages. You might even want to pay something toward your ex's closing costs to get his cooperation.
