Legal Question in Credit and Debt Law in Minnesota

Refusal of My Paymnent

I have old medical debts for my daughter that are now in collection. I have went to court against my ex-husband and have a court order stating he is responsible for these debts. The collection agency refused to accept the court order. They will not remove the debt from my name or credit report. My ex would not pay the debt. I have been paying a small amount every month. The last payment I sent they sent back to me stating the amount was not acceptable and go to the bank and get a loan to pay it. i can't with this on my credit. I have heard if they refuse ANY payment you do not owe the debt. What do I do now?

Re: Refusal of My Paymnent

Hello,

Unfortunately, the way it looks to me is that the medical provider does not have to take your name off the bill and that they can refuse a payment that is less than the full amount; unless you have an agreed payment schedule set up with them. Your options seem to be to enforce your divorce decree against your exhusband or maybe bankruptcy. I cannot advise you however, as to any of these points to the extent you can reply upon my opinion, because I do not have all the facts and you have not retained me to provide counsel. I hope this is helpful and that you will get advice from a lawyer in your area. Mark Mahoney
