Legal Question in Credit and Debt Law in Minnesota
Ugly Duckling Fan Dristributing Repossesion
I had a reposseion of a vehicle in 1998 in the state of Nevada. I had the vehicle approxamatly 1 week when the starter and water pump, went the same day. I called Ugly Duckling and had them reposses the vehicle because of the definciecies. I have lived in Minnesota for the past 12 years. I am currently trying to refinance my home with my wife and when my credit report was run there is a thing for Fan Distributing in the amount of $4000 listed for 2004. I have never received any notice of missing payments or court documents in the past.
Is this even possible? I thought the SOL was only 6 years in the state of Nevada. So if the original repo was in 1998 it should have gone away in 2004 and since it now says 2004 it should have went away this year. If I am correct what can I do to have the entry removed from my credit and to make sure I am not bothered with this anymore?

It seems as if this listing should have been listed on your credit report for 7 years after the first delinquency and dropped off sometime in 2005. Are you aware of any judgments on this (does your credit report show any)???
The first step would in removing an inaccurate entry from your credit report is to dispute it with the credit reporting agency or agencies. We have letters you can use and help consumers with issues like this. Feel free to contact our firm for help.
