Legal Question in Credit and Debt Law in Minnesota

Unbelievable

I have been divorced for 11 years. I live in MN and the divorce was finalized here. I just found out that my ex-husband has had a Discover credit card that still has my name attached to it somehow. He has maxed out the credit and hasn't been making payments. The bill is nearly $10,000. and is ready to go to collection. It has already affected my credit.

How can I get my name removed from his bill? And how can I restore my good credit?

He claims that he didn't know my name was on the account. The card only has his name and all the bills and correspondence only have his name on them.

As you might imagine, I am very upset about his situation.

I called Discover because I have my own account with them and they just said, ''sorry, you're on the his account''.

Please help me get this staightened out.

Re: Unbelievable

The primary tactic here would be to compel him to assume the accounts and notify the CC company of this, with a specific payoff schedule.

In the alternative, we could propose a fraud/ID theft scenario which would add pressure to the CC company to remove your acct and credit info.

Finally, a threat of BKY with a backup plan of negotiating a % payoff settlement would be last resort.

You should be represented in this matter.

I have 25 years of Debtor Creditor experience.
