Legal Question in Criminal Law in Minnesota
In 2001 I was convicted of 2 first degree felonies for meth. I was sentenced to 98 mos over my head and 40 years probation. I have completed tratment. I have also moved onto unsupervised probation as completeing all phases of probation to this point. I live in minnesota but am engaged to a woman in florida who is in the medical field and has never done drugs. I have changed my life around and would like to move to florida, get married and go to school to be a drug counselor at FSU. The sentence of 40 years probation is causing me hardship in all aspects of my life and making it impossible to move forward with my life. Can I get this dismissed due to hardship?

Congratulations on your engagement and good luck with your future endeavors. To that end, it is unlikely that you will get your probation dismissed, at this point. A more practical approach would be to determine exactly where you intend to live, work, etc and then speak to your probation officer. Ask him or her for assistance in recommending a transfer of your probation to that specific county you intend to live and work within in Florida. If denied, then you may want to seek legal counsel to assist in motioning the court to modify your probation.
