3rd degree assult charge

could I really be charged and convicted for 3rd degree asult when I found a guy in my/ our house with my still legal wife, we got into a fight when I told him to leave, we went down the steps and he broke his leg (from falling down the steps)

In "a fight" sometimes a defendant is not guilty by reason of self-defense. The falling down the stairs as cause of injury could in some cases provide a defense of "accident", or that the injury was self-inflicted by the man injured, who chose to fight or who started the fight with an attack. Martial status will have little legal relevance, though might engender some jury sympathy.
