Re: 5th degree domestic abuse
A fifth degree domestic assault is a serious offense even though it is a misdemeanor. It is punishable by 90 days in jail a $700 fine or both. It is very important that you contest these charges.
It is quite likely a civil action called an "Order for Protection" will also be filed. If you are proven to have caused harm or fear of harm an Order for Protection may issue. That Order for Protection may prevent you from entering the home or contacting your girlfriend for up to a year. Moreover, possession of a firearm is a crime if an Order for Protection enters against you.
