Legal Question in Criminal Law in Minnesota

my 13yr old son has been cited for disorderly conduct after an incident in school. The statute/ordinance is 609.72.1.3 what do I do now and what can I expect to happen in court? The date of the offense is 03/10/11. I received the mailing 06/15/11. Is there a time limit on which to file a citation? This is the first time he has ever been in trouble. He is an honor student, involved in every sport offered in our school district, and has many excellent referalls to attest to his character, and behavior. He has verbally aplogised to the victim, and her parents and shown remorse. The parents of the girl did not report incident or press charges. Obviously school contacted authorities, and county attorney instructed charge. Also court date has not been set yet. Having been "in limbo" for so long has made my son sick with worry.

I strongly suggest you contact a criminal defense attorney. Many of us offer free consultations and can review your case and find out the current status. The statute of limitations to file charges for a disorderly conduct (misdemeanor offense) is 3 years. That being said, most people will not have to wait that long.

Talking directly to a criminal defense attorney can help you find out more about your case. Unfortunately, with the limited information, and the difficulty in communicating in a Q&A forum, I cannot give you better advice at this time.

If you would like to contact our office for a free initial consultation, please call. 612-217-0077
