Accident - Pedestrian

My roommate was in a car accident over the weekend. He hit a 15 year old boy who jumped out in front of him on road where the speed limit is 55 mph. The claimed he was trying to cross the street, when his mother got there she said he had sent a text message to his girlfriend stating he way trying to commit suicide. The police took a breathalyzer, came back at 0. Is there any crimal reprocussions that come of this?

It is always possible that criminal vehicular operation could be charged. However, there would have to be some evidence of reckless driving conduct. Based on the facts provided, it would seem that criminal charges would be a remote possibility.

It is possible your friend could be charged with careless or reckless driving, although if the pedestrian actually jumped into traffic, and there is some evidence to support that conclusion, it is not likely a criminal charge would be filed. If, however, the facts are unclear, then the case could be charged, although your friend may have a strong defense.

Your friend should be cautious about statements given to the police or an investigator, and ideally should do so only with the advice of an attorney.
