Legal Question in Criminal Law in Minnesota
Can my attorney appear for me
I'am being charged in MN for passing a forged document, My attorney told me about a plea agreement that they would do and I agread. He told me if I pay restitution they would suspend the jail time, so I paid it. But now he tells me I have to apear befor the judg to sign the agreament. I live in CA, I do not have a way to get there by Feb. Can he fax the plea agreament to me and I sign it and fax it back, so I don't have to apeare? Isn't that why I hiered him, so he can do theese things for me with out me being there? What would be the reason for him not doing this for me? Thank you and I a wait your answer!

In Minnesota, an appearance in person is required. As a result, you must appear to sign a plea petition.

Normally, a defendant is required to appear in court, in person. If the court agrees, however, exceptions to this are sometimes made. It seems unlikely that the court would allow the case to be resolved without your personal appearance in a felony forgery case, however. This is a question best directed to your lawyer.
