Avoiding MN 624.712

I am hoping Maury Beaulier et al can give me some insight...

My friend received a plea offer from the County Attorney - if he pleads guilty to 609.223.1, they will drop 609.222.2 and 609.2242.2 and he will be sentenced to the mandatory minumum of one year and one day.

I very much wish he could avoid a conviction under 624.712. I had a conviction under 624.712 over twenty years ago that I had expunged just last year. It goes without saying that a conviction under 624.712 can affect you for many years...

Do you have ANY suggestions? Any suggestions of some type of counter that might appeal to a County Attorney in that it maintains the length of time served etc but avoids 624.712?

Please; any help would be greatly appreciated!

I just received your question and, without additional facts, cannot offer specific advise. I understand that a weapon was used in an assault, and presume there may have been some injury to the victim. I presume the charges include a felony and several gross misdemeanor counts. Without knowing the facts of the case I cannot comment on whether the prosecutor's offer is reasonable, or what you might offer as an alternative plea or agreement. Whether you can avoid "MN 624.712" (which is merely a definitional section, but by which I presume you mean you want to avoid enhancement due to a firearm), depends entirely on the facts of the case. If you have further questions, or want to discuss the case, call the office on Monday.
