Legal Question in Criminal Law in Minnesota
My boyfriend has a disorderly conduct charge.Will he get jail time if he's had a 5th degree assault charge in the past.I don't know if it matters but we live in Albert Lea Mn.

Thank you for the post. A fifth degree domestic assault, first offense is a misdemeanor and is punishable by up to 90 days in jail and a $1000 fine. There is a presumptive minimum sentence if convicted of 3 days in jail. Moreover, a person convicted of a domestic assault loses certain civil rights including the right to possess a weapon.
