Buying Marijuana on school grounds
On Tuesday, April 20th, my 18 year old son, a senior in school recently was caught buying 1 1/2 oz of marijuana (for $30.00) from a juvenile on school grounds. The prosecutor wants to ''make a statement'' and has charged my son with 4th degree felony for conspiracy to sell, saying it takes two to make a sale. The juvenile has also been charged with this, although he had more marijuana in his glove compartment, packaged to sell. How can the buyer be be accused of the same charge that the seller is? The prosecution has not formally filed any charges yet, but all indications are he will go with the felony. My son has not been allowed to return to school because of this impending charge and may not graduate because he is falling so far behind because of the suspension.

Consult with a criminal defense lawyer ASAP. It sounds like the prosecutor is "blowing smoke." The theory that a buyer is a member of a conspiracy to sell an illegal thing is preposterous. I doubt he or she would dare repeat such to another lawyer, much less charge. It is common for police and prosecutors to threaten and mislead people who are not represented by a lawyer. Talk to a lawyer, soon!
