Legal Question in Criminal Law in Minnesota

Carrying a fake ID

My son(age 19) was stopped while walking home from a bar by a police officer. The officer asked for his ID, which he gave him (real ID). The officer then asked for his wallet, searched it, and found that he was carrying somebody elses drivers license (fake ID.) He was ticketed for carrying a false ID and told he would have to appear in court. Should he be represented by an attorney.

Yes, he should be represented. Depending on the facts he may have a defense to the charge.

Re: Carrying a fake ID

The simple answer to your question is, yes, your son should be represented by an attorney.

Typically, an individual is not charged unless they present a false ID for the purpose of securing services, or if they are engaged in fraud. Whether an ID is "fake" is not so simple a matter as you might imagine, and I wonder if there isn't more to the story, about which you may be unaware.
