Legal Question in Criminal Law in Minnesota

I was caught altering a prescription for a narcotic for the first time, I've never done anything like this befor in my life. I was on some medications that I feel caused me to act eraticlly and make very impulsive desicions. What can I expect for a sentence? I have a small child at home that depends on me to take care of him if that will make a differance?

I assume that you are facing a Misdemeanor charge under Minnesota Statute 151.212 which is punishable by up to 90 days in jail and a $1,000 fine. Although it is unlikely you will see the full sentence, you may be facing some time.

Although the small child may seem like a good argument, and might encourage the State to seek something other than jail time. At the same time, using the child as a shield like this can often have severe consequences, and be looked upon unfavorably.

My best advice for you is to seek a criminal defense attorney. Gather your paperwork, sit down with them and discuss your case.

First, any drug charge is serious and a Misdemeanor charge for a fraudulent prescription is at a minimum a misdemeanor punishable by up to 90 days in jail and a $1,000 fine.

Often, on a first offense, the court favors rehabilitation and, with the assistance of counsel, you may be able to avoid a criminal record that can significantly impact your future.
