Got caught shoplifting

I got caught shoplifting in a deptartment store in MN. This is my first and will be last time ever doing this. I am scared out of my mind now, am married have 2 kids and one on the way. I can't afford an attorney, but will I need one? I have to call the court house in 2wks. I guess. Will I have a criminal record on me now? Help, what to do? I can't believe I did this stupid stupid thing. Please help....

I just received your question about a shoplifting charge, and understand you are quite upset.

Let's start at the beginning. How this will be resolved depends on a few things, such as the city that is prosecuting the offense, where it occurred, how much value was involved, your age, and prior history. In general, if the value of the item was relatively small, you are in the metro area, and have no priors, you will likely end up in a diversion program with the prospect of having a "clean" record provided you comply with probation.

Despite this, you will still have a record, in so far as the fact that you have been charged does not simply go away. This can be a problem, especially for some kinds of employment, since an employer may consider you less trustworthy.

If you cannot afford a lawyer, you may qualify for a public defender. You will have an opportunity to apply for service at your first court appearance. If you do not qualify, you would be well advised to find a way to hire an attorney.
