Legal Question in Criminal Law in Minnesota
How do I get a charge dropped from fealony to a misdemeanor? I have taken pictures prior and after the arrest that shows this woman was in previous car accident. The prosecutor is charging me with criminal damage to property in the 1st degree. The pictures clearly state that the van has a huge dent on the passagenger side! The charges should be petty misdemeanor! There are several other dents in the car from this accident! They have offered me several pleas to drop the fealony to gross misdemeanor if I admit to the crime. I refused to take the plea bargain because I didn't touch this woman car. How do I show the judge that the body shop did estimate for this woman and turn around and charged me for the prior dents that happen from previous accident?

Thank you for the post.
A felony criminal damage to propertycharge is very serious. Under Minneosta Statutes sec 609.595, it carries with it penalties of up to five years or to payment of a fine of not more than $10,000, or both, Any felony conviction can significantly impact your future with collateral consequences as well including a precliusion from travelling to certain countries and/or difficulty in seeking employment where background checks are employed.
There are many defenses to the charge. However, the defenses that apply would depend on the particular facts of your case. Certainly, being aggressive in the defense can often result in a charge reduction. However, the challenges made must be well founded and well presented. As a result, you should retain legal counsel.
