Legal Question in Criminal Law in Minnesota
I was charged with a felony theft when I was 17 years old (Aug, 2005), I was convicted of a gross misdemeanor, as I plead it out and got a reduced sentence and charge. However, the county still filed this as a felony and it has come up in background checks before. How long does it take to have this no longer show up on my record, and if it will not go away, how can I have it expunged (it was a completely non-violent) crime. Any answers could help, thank you very much.

If a person was charged with a felony, but convicted of a gross misdemeanor in Minnesota, and one of the many public government records is in error, generally you can get the error corrected by proving the error to the record-keeping agency. The proof should be a court document. As for expungement, because it was a juvenile matter, you can petition the court for expungement. See: http://www.liberty-lawyer.com/expungement.html
