Legal Question in Criminal Law in Minnesota

I was charged with misdemeanor forgery charges in another state. I wasn't put on probation, wasn't arrested. I had to pay restitution and that was that.. I had the conviction set aside right away so it wouldn't effect my future in the medical field.. it was a bad choice and I'm ashamed of the whole incident. Now after 7 yrs this has resurfaced after I applied for a position at a nursing home as a cna , and they ran a background check. It was reported to the state of MN where I currently live and I have now lost my job and am appealing to the state. Why has this come up in my background check? It hasn't in the past and what can I do to take care of this so it's not coming up. I thought it was in the past and would not affect me now..I was convicted jan 2003

Generally, any criminal offense will appear in the record. It will indicate that the case was dismissed if that was, in fact, the disposition. You would have to seek a lawyer in the state where the offense occurred to determine if you can expunge - seal - the record.
